Everything Wrong With Criminal Justice Is Wrapped Up in This One Case – HotAir

The modern liberal attitude toward criminals and punishment creates so many problems that you would think that it would be impossible to see so many of them wrapped up in one particular case. 





But somehow, the murder of a sweet old man by Rhamell Burke reveals so many dysfunctions wrapped up in a disgusting bow. 

Burke killed retired teacher Ross Falzone by shoving him down the subway stairs. It was caught on camera in all its shocking detail. 

Burke, as with so many crazed murderers, has a long history of criminal activity, in his case related to mental illness, and has been arrested many times, even this year. He killed Falzone mere hours after he had been released from a 1-hour psychiatric evaluation for his violent behavior. 

And the arrests were obviously only for the incidents that got reported. In New York City, you can count on many people not reporting crimes or refusing to aid prosecutors for ideological reasons. 





The courts failed. The psychiatric profession failed. Even the victims failed. And the result was the death of a retired teacher who had never hurt anybody. 

NEW: Repeat offender who had already been arrested several times this year, including for two assaults, killed an elderly man in an unprovoked attack in NYC. 

Hours before the attack, the NYPD had taken Rhamell Burke to a hospital for a psychiatric evaluation after he was reportedly acting irrationally on a Penn Station platform. Mysteriously, he was released just one hour later.

A few hours later  Burke shoved 76-year-old Ross Falzone, a retired teacher, to his death down subway stairs in Manhattan.

Burke was arrested three times in February for assaulting a police officer, burglary, and resisting arrest.

In April, he was arrested again for assaulting a stranger. He was later granted supervised release at arraignment.

Judges in New York City have very strong opinions about incarceration, which is to say that many of them oppose it, which explains why Burke kept getting released to prey upon the populace. 





This sort of thing happens all the time, both in New York City and around the country. Around half of all murders are committed by repeat offenders, and they are out on the street due to the choices of judges who refuse to keep dangerous criminals in jail. 

“Tollinche, who goes by the handle DGB on TikTok, was arrested Sept. 18 and charged with rape, sexual abuse and endangering the welfare of a child for trying to have sex with an 11-year-old girl.  During Tollinche’s arraignment in the sex abuse case, the Bronx District Attorney’s Office requested he be held on $75,000 bail, but a judge gave him supervised release and ordered he wear an ankle monitor.”

Many of the most horrific murders in recent times have been committed by serial felons. Known wolves, as it were, and they roamed the streets solely because the judges decided that they belonged there. Liberal activists, like the woman who refused to cooperate with prosecutors to put Burke in jail, are complicit in this travesty. 





They have blood on their hands. 

Crime is most often committed by criminals. That sounds like a tautology, but the essential fact is that we already know, at least generally, who likely committed any particular crime. It’s not like the list of suspects is indefinitely large, and hence, no secret how to drive crime down if we so choose. 

Having known criminals out on the street is a choice, and most often that choice is made by judges and prosecutors who decide to let them roam the streets. We don’t need judges to be their “authentic selves,” we need them to put criminals in jail. 





Men like Burke are bound to commit more assaults. Just prior to his murder of Falzone, he was being examined by doctors who must have known his history, and did know he was there to be evaluated because he had just assaulted somebody. 

They let him back out onto the streets, just as the judges had before them. Just as the AWFL refused to help prosecutors. 

Overall, crime is down. But random, horrific crimes committed by repeat offenders seem to be expanding. We hear about people being pushed on the tracks with depressing regularity. 

This is a choice, and a bad one.
