Virginia Attorney General Jason Miyares has opened a probe of Loudoun County Public Schools over its investigation of three high school boys who asked why a biological female was in their locker room.
Virginia Gov. Glenn Youngkin said he asked the attorney general to launch an investigation “immediately” into the school district’s conduct, calling the reports “beyond belief.”
“It’s deeply concerning to read reports of yet another incident in Loudoun County schools where members of the opposite sex are violating the privacy of students in locker rooms,” the Republican governor said Tuesday in a statement. “Even more alarming, the victims of this violation are the ones being investigated — this is beyond belief.”
The Founding Freedoms Law Center said its client, a high school sophomore, is facing a Title IX investigation into sexual harassment for asking, “Why is there a girl in the locker room?”
“The female student filed a complaint to school officials after she secretly video-recorded several boys in the locker room, in which some were discussing among themselves discomfort and confusion about why there was a girl changing in their locker room,” the center said in a statement.
Seth Wolfe, the sophomore’s father, said his son is being targeted by the school under the guise of a “sexual harassment” probe.
“My 15-year-old son is being unfairly targeted for simply asking a basic question that any boy would be asking in that situation. It’s astonishing that Loudoun school officials are subjecting him to a formal investigation for a bogus charge that could derail his life,” Mr. Wolfe said.
An LCPS spokesperson said the district cannot comment on the case’s specifics, citing student privacy, but that school officials will investigate or take disciplinary action only for conduct that runs afoul of the student handbook, not for expressing personal opinions.
“Our decision not to comment on the matter should not be taken as license for any news organization to determine what the facts are without verification,” said the spokesperson.
Parental rights are not negotiable.

Mr. Youngkin’s administration issued model policies in 2022 that calls for requiring students to use locker rooms according to their biological sex absent a federal law to the contrary, and notifying parents before a student uses an opposite-sex locker room, then allowing them to opt their children out of using the facility.
This isn’t the first time Loudoun County has faced an outcry over its handling of student conduct. In 2021, the school district was pilloried for transferring a skirt-wearing male student who sexually assaulted a female student to another high school, where he assaulted another girl.
The father of the first girl was arrested and later found guilty of disorderly conduct after he confronted the Loudoun County school board at a 2021 meeting. Mr. Youngkin pardoned the father, while Superintendent Scott Ziegler was fired after a special grand jury accused him of a cover-up.
“This is just the latest example of what happens when school boards disregard common sense,” said Mr. Miyares. “The safety, dignity, and privacy of every student in Virginia should be nonnegotiable. This is about safety and privacy, not political correctness — and it’s time Loudoun County recognized that.”
